Too often, it contains hazardous chemicals\u2014such as <strong>lead, cadmium, mercury, PFAS, BPA, and phthalates\u2014that can leach into food, water, and the environment<\/strong>. These substances also contaminate recycling streams, lowering the value of recycled materials and polluting future products.<\/p>\n\n\n\n<p>Out of 16,000 chemicals identified in plastics, 4,200 are hazardous\u2014persistent, toxic, and mobile in the environment. (PlastChem)<\/p>\n\n\n\n<p><strong>This is not just a recycling problem. It\u2019s a health, safety, and economic issue.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">We Have an Opportunity to Get Recycling Right<\/h2>\n\n\n\n<p>Colorado\u2019s <a href=\"https:\/\/leg.colorado.gov\/bills\/hb22-1355\" target=\"_blank\" rel=\"noreferrer noopener\">Producer Responsibility for Packaging and Paper Act (HB22-1355)<\/a> will expand recycling to every household across the state in 2026. Companies that sell packaging in Colorado will begin funding the recycling system\u2014and how much they pay into the system will depend on the type of packaging they produce. <strong>This system is called <em>eco-modulation<\/em>, where producers pay more for wasteful or hard-to-recycle materials and pay less for packaging that\u2019s recyclable or reusable.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What Is Eco-Modulation?<\/h2>\n\n\n\n<p><strong>Eco-modulation is a specific financial incentive system<\/strong> <strong>that determines how much producers pay into the recycling system by assigning:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Bonuses:<\/strong> discounts for safer, recyclable designs (or environmentally positive changes in packaging).&nbsp;<\/li>\n\n\n\n<li><strong>Penalties (called \u201cMaluses\u201d):<\/strong> extra fees for harmful, wasteful packaging (or environmentally negative changes in packaging)<\/li>\n<\/ul>\n\n\n\n<p><em>Right now, draft eco-modulation rules for Colorado don\u2019t explicitly require reducing toxic chemicals in packaging.<\/em><\/p>\n\n\n\n<p><strong>&gt;&gt; Colorado\u2019s Solid and Hazardous Waste Commission\u2019s eco-modulation rulemaking this fall is our chance to ensure that the Commission approves the best possible eco-modulation rules for Colorado\u2019s Producer Responsibility.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What\u2019s at Stake<\/h2>\n\n\n\n<p>By reducing toxic chemicals through eco-modulation, Colorado can:<\/p>\n\n\n\n<p><strong>Protect public health.<\/strong> Align with states like California, Maine, Washington, and Minnesota, whose Producer Responsibility programs will cut toxic chemicals.&nbsp;<\/p>\n\n\n\n<p><strong>Safeguard recycling value.<\/strong> Toxic additives contaminate recycling streams, make materials more difficult to process, and lower their market value\u2014especially for food-grade packaging, where manufacturers need clean, high-quality recycled materials. We can protect the value of recycled materials by cutting toxins in the design phase.<\/p>\n\n\n\n<p><strong>Strengthen markets.<\/strong> Clean, toxin-free recycled material feedstocks are essential for manufacturers. Reducing toxics builds stronger markets and a healthier circular economy.<\/p>\n\n\n\n<p><strong>Lead the nation.<\/strong> With Colorado among the first US states to design eco-modulation rules, our decisions will help set the standard for the entire country and show how Producer Responsibility can protect health, improve recycling, and make safer packaging the norm.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What We\u2019re Asking For<\/h2>\n\n\n\n<p><strong>We urge Colorado regulators to:<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Disallow bonuses for toxic packaging.<\/strong> Producers that intentionally add hazardous chemicals should not be eligible for eco-modulation \u201cbonuses.\u201d&nbsp;<\/li>\n<\/ol>\n\n\n\n<ol start=\"2\" class=\"wp-block-list\">\n<li><strong>Expand and clarify eco-modulation rules. <\/strong>Eco-modulation rules must reflect the law\u2019s&nbsp; intent to minimize environmental, social, economic, and health impacts caused by packaging.<\/li>\n<\/ol>\n\n\n\n<ol start=\"3\" class=\"wp-block-list\">\n<li><strong>Define \u201ctoxicity\u201d and \u201cintentionally added toxic chemicals.\u201d <\/strong>Regulations should spell out what counts as toxicity and include a list of banned chemicals.<\/li>\n<\/ol>\n\n\n\n<ol start=\"4\" class=\"wp-block-list\">\n<li><strong>Make incentives meaningful.<\/strong> Current draft rules offer just 1% bonuses, and are&nbsp; capped at 10%\u2014that\u2019s not enough to drive change. Proven systems abroad offer bonuses of 20% or more\u2014Colorado should do the same.<\/li>\n<\/ol>\n\n\n\n<ol start=\"5\" class=\"wp-block-list\">\n<li><strong>Align with existing Colorado laws.<\/strong> Producers that use materials already restricted in Colorado\u2014like expanded polystyrene (banned under HB21-1162) and PFAS (restricted under HB22-1345)\u2014should not qualify for eco-modulation bonuses.<\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\">How You Can Help<\/h2>\n\n\n\n<p><strong>Your voice is critical.
